If the dispute is not resolved within 30 (thirty) days from the commencement of such negotiations, it shall be finally resolved through binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended) of India. The arbitration shall be conducted by a sole arbitrator appointed mutually by the parties. The seat and venue of arbitration shall be Mumbai, India, and the arbitration proceedings shall be conducted in English. The award rendered by the arbitrator shall be final and binding on the parties. In the event that any dispute requires judicial intervention, the courts situated in Mumbai, India shall have exclusive jurisdiction over such matters.

Injunctive Relief

The User acknowledge and agree that any breach or threatened breach of this User Agreement and these Terms and Conditions may cause irreparable harm to Akbar Travels, for which monetary damages may be an insufficient remedy, and the precise amount of such damages would be difficult to ascertain. Accordingly, Akbar Travels shall be entitled, as a matter of right, to seek injunctive or equitable relief from any court of competent jurisdiction, without the requirement of posting any bond or other security, to prevent or restrain any actual or threatened violation of these Terms and Conditions by You or your affiliates, partners, or agents.

In addition to injunctive relief, Akbar Travels shall be entitled to recover from the user any and all costs and expenses incurred in obtaining such relief, including, but not limited to, reasonable attorneys' fees and court costs.

If any provision of these Terms and Conditions is held to be invalid or unenforceable under applicable law, such provision shall be interpreted in a manner consistent with applicable law to reflect, as closely as possible, the original intent of the parties. All remaining provisions shall continue in full force and effect.

Electronic Record and Legal Validity This document is an electronic record as defined under the provisions of the Information Technology Act, 2000, and the applicable rules made thereunder, including the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.
